An Independent Children’s Lawyer (ICL) will represent a child’s interests in cases which involve very serious and complex issues, and/or where there is a high level of conflict between the parties. Appointment of an ICL can be requested by the Federal Circuit and Family Court of Australia.
The role of an ICL is to provide an independent view as to which arrangements and decisions may be in the child’s best interest.
An ICL can meet with the child to obtain his/her views about particular decisions or arrangements. However, they are not required to follow the child’s instructions. They may also speak to relevant parties at the child’s school, psychologists/counsellors or other medical professionals, and make other enquiries about the child and their living situation as required.
